Welcome to Schattenwachter (“Schattenwachter,” “we,” “us,” or “our”), available at schattenwachter.com. These Terms of Use (“Terms”) govern your access to and use of our website (schattenwachter.com), the Schattenwachter monitoring application (the “App”), and all related services, features, and content (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services. These Terms incorporate our Privacy Policy and Refund Policy by reference.

1. Eligibility and Authorization

The Schattenwachter Services are intended solely for parents or legal guardians (“Parents”) to monitor and manage the devices and online activities of their own minor children under their direct supervision.

To use the Services, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Have the legal right and authority to monitor the devices and activities of the child(ren) linked to your account
• Not be prohibited by law from using monitoring software

By using the Services, you represent and warrant that you meet these requirements. Use of the Services to monitor individuals who are not your own minor children may violate applicable laws.

2. Description of Services

Schattenwachter provides parental control and device monitoring tools, including (but not limited to):

• Activity monitoring (app usage, browsing history, screen time)
• Content filtering and blocking
• Location tracking (when enabled)
• Alerts and detailed reports accessible via the dashboard

The Services are provided “as is” and may be updated or modified from time to time at our sole discretion.

3. User Accounts and Responsibilities

You must create an account with accurate information to access full features. You are solely responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account

Parental Consent: Before linking a child’s device, you must ensure you have the legal authority and, where required by law, obtain any necessary consent. You agree to use the Services only for lawful parental supervision purposes.

Prohibited Conduct: You agree not to:

• Use the Services to monitor any person other than your own minor children
• Use the Services for any illegal or unauthorized purpose
• Attempt to interfere with, reverse engineer, or gain unauthorized access to the Services
• Transmit viruses, malware, or harmful code
• Provide false or misleading information
• Violate the privacy or legal rights of any third party

We reserve the right to suspend or terminate your account immediately for any violation of these Terms, without prior notice.

4. Fees and Payment

Certain features require a paid subscription. Fees are clearly displayed on our website. You agree to pay all applicable fees using a valid payment method. Subscriptions may auto-renew unless canceled according to our cancellation process.

Refunds are governed by our separate Refund Policy. We do not guarantee refunds outside the terms specified in that policy.

5. Intellectual Property

All content, software, logos, designs, and materials on the Services are owned by Schattenwachter or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial parental monitoring purposes only, in accordance with these Terms. You may not copy, modify, distribute, reverse engineer, or create derivative works of the App or any part of the Services without our prior written consent.

6. Termination

You may terminate your account at any time by contacting support or following the cancellation process in your dashboard. We may terminate or suspend your access to the Services at any time, with or without notice, for violation of these Terms or for any other reason.

Upon termination, your right to use the Services ends, and you must uninstall the App from all devices. Certain provisions (including limitation of liability, intellectual property, and governing law) survive termination.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, error-free, or will meet all your expectations. Parental control tools assist in supervision but cannot eliminate all risks associated with children’s online activities.

8. Limitation of Liability

To the fullest extent permitted by law, Schattenwachter shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Services, even if advised of the possibility of such damages.

Our total liability to you shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Schattenwachter, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorney fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your monitoring activities or breach of applicable laws

10. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on our website with a new “Last Updated” date. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Spain, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the competent courts of Spain
